Short answer

Yes. Resolution 173/2024/QH15 prohibits the use of electronic cigarettes and heated tobacco, not only their production and sale, in force from 1 January 2025. Administrative penalties are set out in Decree 371/2025/ND-CP. We do not summarise the amounts and we give no legal advice.

Key points

  • Resolution 173/2024/QH15 lists use within the prohibition.
  • In force from 1 January 2025.
  • Administrative penalties sit in Decree 371/2025/ND-CP.
  • The amounts have to be read from the instrument itself.

What the text says

National Assembly Resolution 173/2024/QH15 prohibits the production, trade, import, storage, transport and use of electronic cigarettes and heated tobacco products. In force from 1 January 2025.

The word people miss is use. The ban is not aimed only at sellers.

The penalties

Decree 371/2025/ND-CP sets out the administrative penalties. That is where the figures live.

We do not summarise the amounts on this page. The penalty depends on the specific act, and a wrong summary is worse than none.

If you are using and want to stop

Nicotine dependence from a pod is still nicotine dependence. The methods with clinical evidence are the same as for cigarettes: quitline counselling on 1800 6606, nicotine replacement therapy, and prescription medication on a doctor’s advice.

The line is free, 08:00 to 22:00 daily.

What this page does not do

No legal advice, no inference about scope, no penalty figures. We name the instruments in force so you can read them directly.

Common questions

What is the actual fine?
The amounts are set in Decree 371/2025/ND-CP. We do not state figures here because the penalty depends on the specific act and has to be read from the text. If you need a conclusion for your situation, ask a lawyer.
Is carrying a personal device for own use prohibited?
The resolution lists storage and transport alongside use. How that applies to a specific situation has to be read from the original text and is a question for legal advice.
